1. The Service

Flowent is an AI-powered language learning platform that provides real-time voice conversation practice, scenario-based roleplay, structured courses, and progress analytics. The service is designed for individual learners and educational institutions.

2. Accounts

• You must provide accurate information when creating an account.
• You are responsible for maintaining the security of your account credentials.
• You must be at least 16 years old to use Flowent, or have parental/guardian consent.
• If you are using Flowent through an educational institution, your instructor may have access to your practice session summaries and progress data as described in our Privacy Policy.

3. AI-Powered Features

• Flowent uses AI language models (Google Gemini via Vertex AI) to power conversation practice, feedback, and hint generation. AI responses are generated automatically and may occasionally be inaccurate or imperfect.
• Flowent is a practice tool, not a certified language assessment or accreditation service. AI-generated scores and feedback are indicative, not definitive.
• Audio from live practice sessions is processed in real time and is not stored after the session ends. Text transcripts and session analytics are retained as described in our Privacy Policy.

4. Acceptable Use

You agree not to:

• Use the service for any unlawful purpose or in violation of any applicable laws.
• Attempt to gain unauthorized access to our systems, other accounts, or data.
• Interfere with or disrupt the service or its infrastructure.
• Use automated tools to access the service (bots, scrapers) without written permission.
• Share your account credentials with others.
• Use the AI conversation features to generate harmful, abusive, or inappropriate content.

5. Usage Limits

To ensure fair access for all users, Flowent may impose limits on voice practice time, API requests, or session frequency. These limits vary by plan and may be adjusted. We will notify you if you are approaching or have reached a limit.

6. Instructor & Institutional Use

• Instructors can create courses, assign lessons, and invite students. Instructors are responsible for ensuring they have appropriate consent to enroll students.
• Instructors can view aggregated and per-student practice analytics (session summaries, task completion, areas of difficulty). They cannot access raw audio recordings.
• Institutions using Flowent for classes must comply with their own data protection obligations (e.g., informing students about data processing).

7. Intellectual Property

• Flowent and its content (including AI models, course materials, and the platform itself) are owned by Flowent and protected by intellectual property laws.
• Content you create (custom scenarios, course materials) remains yours. By uploading it, you grant Flowent a license to host and display it within the service.

8. Availability & Modifications

We aim to provide a reliable service but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue features with reasonable notice. We will not delete your data without notice except in cases of Terms violations.

9. Limitation of Liability

Flowent is provided "as is". To the maximum extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service. Our total liability is limited to the amount you have paid us in the 12 months preceding the claim.

10. Termination

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms. Upon termination, your data will be handled according to our Privacy Policy (deleted within 30 days unless legally required to retain).

11. Governing Law

These Terms are governed by the laws of the European Union and the applicable member state where our entity is established. Disputes will be resolved in the competent courts of that jurisdiction, without prejudice to your rights under applicable consumer protection laws.

12. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of Flowent after changes constitutes acceptance of the updated Terms.
